Terms of Sale and Export Compliance Agreement

The U.S. Department of State's Directorate of Defense Trade Controls (DDTC), the U.S. Department of Commerce's Bureau of Industry and Security (BIS), and the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) administer export control regulations that affect certain products sold by On Point Optics. Customers are required to read and familiarize themselves with the following regarding applicable export regulations.
The sale, transfer, transportation, or shipment outside of the United States of any restricted or prohibited product without complying with U.S. export control laws and regulations, including obtaining proper export licensing, documentation, or authorization, is strictly prohibited. Violations of these regulations may result in severe civil and criminal penalties. On Point Optics will not engage in transactions involving illegal exports or re-exports of products, nor assist directly or indirectly with such activities.
If you intend to purchase an item for shipment or use outside of the United States, you must clearly indicate this at the time of your order. Depending on factors such as the order value, specific products ordered, end user, destination country, and intended use, On Point Optics may be required to obtain an export license from the appropriate U.S. government agency. Items potentially requiring an export license include, but are not limited to:

Generation 2, 3, or 4 Night Vision Equipment and Accessories

Thermal Imaging Equipment

Optical Sighting Equipment, Tactical Lights, and Accessories

Tactical Gear and Firearm Accessories

Knives
-
Military Apparel, Body Armor, Helmets, and Shields

Certain Laboratory and Electronic Equipment
International Traffic in Arms Regulations (ITAR):
Certain products sold by On Point Optics are subject to ITAR and require explicit authorization or a license from the DDTC for export. By proceeding with the purchase of any ITAR-restricted item, the Customer certifies that:

The purchase does not obligate On Point Optics to export the items without obtaining proper U.S. Government authorization.

The Customer will not export, transfer, sell, or furnish the item to any foreign person, foreign entity, or foreign government without proper authorization.

The Customer understands that under ITAR § 120.16, a foreign person includes individuals who are not lawful permanent residents or protected individuals as defined by U.S. law, as well as foreign corporations, entities, governments, or diplomatic missions.

The Customer is a U.S. Person as defined by ITAR § 120.15 (a lawful permanent resident, protected individual, U.S.-incorporated entity, or government entity).
Export Administration Regulations (EAR):
Certain products sold by On Point Optics are subject to EAR, and export may require authorization from the BIS. By purchasing EAR-controlled items, the Customer certifies that:

The purchase does not require On Point Optics to export such items unless proper U.S. Government authorization has been obtained.

The Customer will not export, re-export, or transfer such items without appropriate U.S. Government export authorization.
Important Export Restrictions Warning:

Export of certain products sold by On Point Optics requires a valid export license from the DDTC (ITAR, 22 C.F.R. 120-130) or BIS (EAR, 15 C.F.R. 730-774).

U.S. law prohibits sales, transfers, or exports to certain restricted parties, destinations, or embargoed countries identified by the DDTC, BIS, and OFAC. The Customer is responsible for being aware of these restrictions.
By proceeding with any transaction, the Customer certifies compliance with all applicable laws, regulations, and policies.

On Point Optics reserves the right to request end-user and end-use certifications and may cancel or refuse any transaction suspected of violating U.S. export regulations.
